1. GENERAL PROVISIONS:

The terms and conditions apply to online purchases made on the website www.cupiocosmetics.com. They establish the conditions and specify the rights and obligations of the seller and the buyer (customer, consumer). The seller and operator of online operations is SC RAZADI SRL with registered office in Timisoara, Str. Felix, No.25, Sc.B, Ap.2, Jud. Timis and correspondence address: Cupio - central warehouse, CTPark, TIM4 building, unit F, Calea Lugojului, No. 148, Ghiroda, postal code 307200, Timis County.

Cupio, as a registered trademark of Razadi SRL, is registered at European Union Intellectual Property Office

DEFINITIONS:

Seller - SC RAZADI SRL (owner of the registered trademark CUPIO).

Sales Contract - any contract under which the seller transfers or undertakes to transfer ownership of products to the customer (consumer, buyer), and the customer pays or undertakes to pay the price.

Consumer (customer, buyer) - any individual or group of individuals acting outside their business, industrial, production, artisanal, or liberal activity in accordance with the contractual terms and conditions

Shopping cart - the section in the account that allows the buyer/customer to add products they wish to purchase at the time of adding or at a later time.

Website – the online store hosted at www.cupiocosmetics.com.

Order – an electronic document that constitutes a form of communication between the Seller and the Buyer, through which the Buyer communicates to the Seller, through the Website, their intention to purchase products from the site.

Products - any items to be provided by the Seller to the Buyer as a result of the concluded Contract.

AVAILABILITY OF PRODUCTS:

The products provided on the website www.cupiocosmetics.com may have one of the following availabilities:

• "in stock" - we have more than 10 pieces in the seller's stock;
• "out of stock" - the item is no longer available in the seller's stock.

In the event that a product is not available in stock (out of stock/temporarily unavailable) after the customer has placed the order, the seller will make all necessary arrangements to deliver the order to the customer.

 PRODUCT ORDERING:

To order products from the www.cupiocosmetics.com interested persons must access the website mentioned above.

To place an order, the customer must select the products they wish to purchase and add them to the shopping cart.

To finalize the order, the customer must complete the form provided for this stage and then select the "place order" button.

After this procedure, the customer will receive a message from the seller notifying them that their order has been received and is being processed.

The processing of the order involves internal operations carried out to ensure optimal communication and operation of the responsible departments

Orders are processed based on the date they were placed.

Please note that order processing does not imply order delivery.

Once the order is processed, it will be communicated to the relevant department for identification, selection, packaging of the products included in the order.

If any products are no longer in stock at the time of packaging, they will be automatically removed from the order without prior notice to the consumer (customer, buyer).

After the products have been identified, selected, and packaged, they will be sent for delivery to the courier according to the placed order.

The process of identifying, selecting, and packaging the products (for courier dispatch) included in the order will take 1-2 business days from the order processing.

Cupio has made every effort to display the colors of the products as accurately as possible. However, the color of the items displayed on the screen may vary depending on the quality of the device used to view the product.

Therefore, Cupio cannot guarantee that the colors displayed on the monitor are a faithful representation of the actual colors.

Products for which the color cannot be selected will be delivered based on the available stock color at the time of delivery.

PRODUCT DELIVERY

The delivery of products within Romania is carried out within 1-3 business days from the identification, selection, and packaging of the products.

The delivery of products within the EU is carried out within 3-6 days from the identification, selection, and packaging of the products.

Once the products included in the order (package) have been handed over to the courier, the customer will be notified by SMS.

Orders cannot be combined, each placed order is separate. Multiple orders cannot be placed and then combined.

For example, if a customer places 2 orders, both with shipping fees, then the orders will be collected separately, and the shipping fee will be charged for each order. Each package will contain the products added to the respective order.

The delivery deadlines mentioned in this section may be modified due to objective factors beyond the seller's control, such as legal holidays, unfavorable weather conditions, periods of discounts, busy periods, technical problems independent of the seller's will, etc.

PHONE ORDERS:

Placing phone orders is done at the customer's own risk. SC RAZADI SRL is not responsible for any errors/misunderstandings regarding the address, telephone number, products, color shades, etc.

ORDER CANCELLATION:

There are situations in which an order cannot be delivered to the customer for various reasons (unavailable product, non-compliance with kits, incomplete/incorrect delivery details, etc.). In such cases, the customer will be contacted by phone by a Call Center representative. If the customer does not answer the phone, they will receive a written notification via email explaining the situation and requesting a response. If the customer does not contact us within 48 hours (business days) by replying to the notification email or by phone at 0372 917 306 (Monday to Friday, between 9:00-17:30), the order will be automatically canceled in the system.

The customer can also benefit from the right to cancel the order, in the event that he informs the seller of his intention, before concluding the contract.

The customer also has the right to cancel the order by informing the seller of their intention before the order is handed over to the courier for transport.

PRICE:

The prices of the products are expressed in RON (Romanian currency), and VAT is included in the displayed price.

The final price paid by the customer consists of the purchase price of the product plus the transportation cost. SC RAZADI SRL does not charge any additional fees. All products will be delivered subject to availability. The vouchers or other loyalty methods are not transferable and cannot be combined.

Discount codes, vouchers, and loyalty cards apply only to Cupio branded items.

The shipping fee is calculated based on the actual amount paid after applying the discount coupon.

The shipping price will be displayed for each individual order within the "Finalize order" section.

The prices are valid from the time of publication, except in cases where there are material errors, especially but not limited to cases where the prices have been displayed with significant differences from the selling price or displayed incorrectly due to a system error.

In such cases, the seller is not obliged to deliver the product at the incorrect price. The seller will inform the customer about this and offer to deliver the product/products at the actual price.

PRELIMINARY SPECIFICATIONS:

Prices are mentioned next to each product and are expressed in Romanian Leu (RON - the currency of Romania), and VAT is included in the displayed price. The final price paid by the customer is composed of the purchase price of the product, plus the cost of transportation. Cupio.ro does not charge any additional fees. All products will be delivered subject to availability.

Cupio.ro complies with current legal provisions regarding Government Ordinance no. 99 of August 29, 2000 (republished) regarding the marketing of goods and services.

The manner of indicating the prices of products offered to consumers for sale, as well as information for consumers related to price reductions, can be found next to each product by mentioning the new price next to the previous price, which is crossed out.

PRIVACY POLICY AND DATA SECURITY:

SC RAZADI SRL processes personal data for the following purposes:

• creating a customer account;
• logging into the customer account;
• online shopping;
• payment, refunding in case of product returns/cancellation of orders;
• delivering products;
• customer support;
• loyalty actions/benefits;
• promotional campaigns, contests, promotions, or raffles;
• creating customer profiles for direct marketing purposes;
• online browsing;
• behavioral advertising;
• personalized audience-based offers (customer lists);

• Razadi S.R.L., as the owner of the Cupio brand, undertakes not to transmit personal data of users of the website to third parties, except for direct collaborators who have legal and necessary access to certain data for the provision of services (email marketing/newsletter services, payment processors, courier companies, etc.). Cupio.ro undertakes to comply with the legal provisions guaranteeing the security and confidentiality of the hosted and transmitted data through its IT system.

Personal data of users may be transmitted to and processed by certain third parties (suppliers and business partners) for marketing purposes or service provision, in full compliance with the Guide on the processing of personal data on the Cupio.ro online store. Additionally, personal data of users may be transmitted to public institutions or authorities when there is a legal obligation or at their request or to the courts for the exercise of the right to defense.

SC RAZADI SRL will use users' personal data to notify them about promotional offers and updates through the website's newsletter and to send coupons, greetings, or other messages. The personal data provided by users is necessary for order confirmation, delivery of the ordered products, and subsequent cooperation between Cupio.ro and its customers. If the customer no longer wishes to receive the newsletter, they can unsubscribe by simply clicking on the link received via email from cupio.ro or by any other means provided by Cupio.ro.

SC RAZADI SRL does not sell, offer, or exchange email addresses obtained through this website, nor disclose your email address to other persons accessing the pages of this website without your explicit consent, except in cases mentioned in the Guide on the processing of personal data on the Cupio.ro website.

SC RAZADI SRL will process users' personal data for the period necessary to fulfill the purposes for which they were collected, in accordance with SC RAZADI SRL's policies on the retention of personal data. In certain cases, certain legal provisions may require or allow data retention for a longer period. User data will be kept for the duration of a customer account and/or online purchases from the Cupio website. Deactivating the customer account on the Online Store will result in the deletion or anonymization of user data to prevent their identification in SC RAZADI SRL's data records, except when there is a legal obligation or legitimate interest in keeping the data for a longer period.

PRODUCT WARRANTY:

All products sold on www.cupiocosmetics.com benefit from warranties in accordance with the applicable legislation. The products are new, in original packaging, and benefit from the legal warranty of conformity, according to the provisions of Law no. 296/2004 on Consumer Protection, with subsequent modifications and completions, together with the provisions of Government Emergency Ordinance no. 140/2021 regarding the sale of products and associated guarantees, with subsequent modifications and completions.

Electronic/electric products purchased through www.cupiocosmetics.com benefit from the commercial warranty provided by the manufacturer for a specified period, according to each product. Therefore, each delivered electronic/electric product will be accompanied by a warranty certificate or conformity declaration with the manufacturer's or importer's specifications.

In case electronic products become defective and are covered by the warranty period mentioned above, the customer can send the defective product to the address provided in the contact section for repair purposes.

In this case, the shipping costs will be paid as follows: the customer covers the transport costs when sending the product to the service, and the seller will cover the transport costs when sending the product back to the customer.

PRODUCT RETURNS:

In accordance with the provisions of Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, including distance contracts, and subsequent modifications and completions, the customer (consumer) has the right to withdraw from a distance contract or a contract concluded off-premises without justifying the decision within 14 calendar days, without bearing any costs other than those related to the return of the product.

INFORMATION AND COMMUNICATION:

Individuals visiting the website www.cupiocosmetics.com can make comments and other communications through contact and/or order forms, share information or opinions on the forum for each product, or through the email address hello@cupiocosmetics.com, as long as the content is not illegal, obscene, threatening, or defamatory. If information, materials, or documents are sent through any possible method, including email, mail, online forms, it will be considered that the user grants S.C. Razadi S.R.L. unlimited, free, irrevocable right to use, reproduce, modify, adapt, distribute, and present this information by any means

Placing an order on cupio.ro or the automatic confirmation of an order cannot be considered as the establishment of a contractual agreement and does not constitute a pre-contract.

CUSTOMER CONCILIATION:

In cases where certain incidents cannot be resolved through email or phone discussions with the responsible persons, free internal conciliation with Ms. Raluca Stefanescu can be requested. In this regard, the customer must send an email to raluca.stefanescu@cupio.ro

The response time is 1-2 business days from confirming receipt of the email.

FRAUD

Any attempt to access personal data of other users or to alter/modify the content of www.cupio.ro, or affect the server on which the website runs, will be considered an attempt, and Razadi S.R.L. reserves the right to file a criminal complaint against those who have attempted the aforementioned acts. Fraud also includes placing an order with a false address or false identification information. In this case, the competent authorities will be notified to resolve the case.

DISPUTES

Razadi S.R.L., the owner of the Cupio.ro brand, will make every effort to resolve any disagreements regarding any type of dispute between the parties through amicable means by their representatives. If the disagreements cannot be resolved amicably, resolving the disputes will be the responsibility of the competent court in Romania.

SC RAZADI SRL reserves the right to modify these provisions in accordance with legal provisions, to better serve the legal relationship between the distributor and users, without prior notice.
